1. Introduction

Welcome to Bhaav Sangeet Vidhyalaya (“we,” “us,” “our,” or “the Academy”). These Terms & Conditions (“Terms”) govern your use of our website (bhaavsangeet.com) and your enrollment in any course, program, or service offered by the Academy.

By accessing our website or enrolling in our programs, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.

2. About Us

Bhaav Sangeet Vidhyalaya is a music academy based in Budhanilkantha–9, Mandikhatar, Kathmandu, Nepal, offering vocal and instrumental music training, including but not limited to piano, guitar, madal, tabla, tanpura, and harmonium, along with online practice resources through our website.

3. Eligibility

• Our courses are open to students aged 7 years and above.
• Students under the age of 18 must have a parent or legal guardian’s consent to enroll.
• We reserve the right to refuse or cancel enrollment at our discretion, including where eligibility requirements are not met.

4. Enrollment

• Enrollment requires submission of accurate personal information (name, age/date of birth, contact details, and parent/guardian information for minors).
• No prior documents or trial class are required for enrollment; enrollment is confirmed upon submission of the required personal information and payment of applicable fees.
• The Academy reserves the right to verify submitted information and to decline enrollment if information provided is found to be false or incomplete.

5. Course Fees and Payment

• Course fees must be paid via cash or bank transfer. We do not currently accept online payment gateways (e.g., eSewa, Khalti).
• Fee amounts, payment schedules, and due dates will be communicated at the time of enrollment.
• Fees must be paid on time to maintain active enrollment. Continued non-payment may result in suspension or termination of enrollment.
• All fees are subject to periodic review and may change with prior notice.

6. Refund & Cancellation

Please refer to our separate Refund & Cancellation Policy for full details. In summary:

• Refund requests must be made within 7 days of enrollment/payment.
• A 50% refund may be granted if a student is unable to continue their course, subject to review by the Academy.
• No refund will be issued for requests made after the 7-day period.

7. Class Schedule, Attendance & Conduct

• Students are expected to attend classes regularly and arrive on time.
• The Academy reserves the right to reschedule or cancel classes due to instructor availability, holidays, or unforeseen circumstances, with reasonable prior notice where possible.
• Students and parents/guardians are expected to maintain respectful and disciplined conduct during classes, rehearsals, and performances.
• Repeated absence, disruptive behavior, or failure to follow academy rules may result in suspension or termination of enrollment, at the Academy’s discretion.
• Parents/guardians are generally not permitted to remain present in the classroom during regular sessions, in order to maintain a focused learning environment, unless otherwise arranged with the Academy.

8. Use of Website and Online Tools

• Our website provides free online music practice tools (e.g., piano, madal, metronome, tabla, tanpura) for educational and practice purposes only.
• These tools are provided “as is,” and the Academy makes no guarantee of uninterrupted or error-free availability.
• You agree not to misuse the website, including attempting unauthorized access, disrupting website functionality, or using content for unlawful purposes.
• Some tools or pages may be under construction or updated periodically; availability may change without prior notice.

9. Intellectual Property

• All content on this website — including text, logos, images, course materials, and online tools — is the property of Bhaav Sangeet Vidhyalaya unless otherwise stated, and is protected under applicable copyright and intellectual property laws.

10. Photos, Videos & Media

• The Academy may capture photographs or videos of students during classes, rehearsals, and performances for use on our website and social media, subject to parental/guardian consent as described in our Privacy Policy.
• By providing consent, parents/guardians agree that such media may be used for promotional and educational purposes by the Academy.

11. Limitation of Liability

• The Academy strives to provide quality music education but does not guarantee specific outcomes, skill levels, or performance results, as progress depends on individual effort and practice.
• The Academy is not liable for any indirect, incidental, or consequential damages arising from the use of our website, online tools, or participation in our programs.
• Students and parents/guardians participate in classes, rehearsals, and performances at their own risk, and the Academy is not responsible for personal injury, loss, or damage except where caused by proven negligence on the part of the Academy.

12. Termination

The Academy reserves the right to suspend or terminate a student’s enrollment at its discretion in cases of:

• Non-payment of fees
• Violation of these Terms or academy conduct rules
• Behavior deemed harmful to other students, staff, or the Academy’s reputation

We may update these Terms from time to time to reflect changes in our services or for legal reasons. Updates will be posted on this page with a revised “Last Updated” date. Continued use of our website or services after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of Nepal. Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Kathmandu, Nepal.
